HD-26-509 First Reading of Emergency Ordinance related to establishing an Operating Agreement with Alameda Belt Line for the provision of Railroad Operations and Maintenance Services to the Port of Long Beach. (Tenant Services - R. Delgado) (1) Find that the provisions for use of the Pier B On-Dock Rail Support Facility in accordance with the Agreement is a subsequent approval within the scope of the Pier B On-Dock Rail Support Facility Project Environmental Impact Report certified by the Board of Harbor Commissioners on January 22, 2018; and the provisions for operations and maintenance of the Port Rail Facilities and Port Complex Area are categorically exempt from the California Environmental Quality Act under State CEQA Guidelines pursuant Section 15301 (Class 1. Existing Facilities), Section 15302 (Class 2. Replacement or Reconstruction), Section 15303 (Class 3. New Construction or Conversion of Small Structures), and Section 15304 (Class 4. Minor Alterations to Land). (2) Deny Protest of Pacific Harbor Line, Inc., and waive any irregularities, deficiencies or omissions in the proposal submitted by Alameda Belt Line, Inc. (3) Approve First Reading Authorizing Chief Executive Officer, or their designee to execute such agreement. (4) Declare this Ordinance an Emergency.
