CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION

2CS. Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9 of the Government Code (one case). Pursuant to paragraph (2) of subdivision (e) of Section 54956.9 of the Government Code, the facts and circumstances which might result in litigation consists of Manson Connelly, JV's assertion of delay, disruption and inefficiency claims concerning work space constraints during the Pier E Berth E22 Wharf & Backlands, Stage 3, Phase 3 project.

CONFERENCE WITH REAL PROPERTY NEGOTIATORS

3CS. Closed session pursuant to Section 54956.8 of the Government Code for conference with negotiator Duane Kenagy to discuss price and terms of the proposed design-build contract for the Gerald Desmond Bridge Replacement Project and subsequent conveyance of the bridge to the State of California. The negotiating parties are Shimmick Construction Company, Inc./FFC Construction S.A./Impreglio S.p.A., a joint venture and the State of California, Department of Transportation.
